Legal Issues in the Use and Abuse of Student Records
Abstract
One of the purposes of this article is to point out legal issues that may possibly govern access to college and university records and which have not previously been analyzed in association with the Buckley Amendment or with state laws. A second purpose of this article will be to suggest some extremely important issues which might arise in future litigation in this area and which, in general, have not been dealt with by any legislation, federal or state, governing access to student records. These are issues which impact directly upon archivists and others who are not directly involved in the initial creation or use of such records.
